1.OUTBACK AUTOMOTIVE LTD (hereinafter referred to as ‘the company’) The Buyer (hereinafter referred to as ‘the customer’)

2. PRICES – The prices quoted are that of the company’s price list current at the time of printing, and are subject to change without notice to reflect any direct or indirect increase in cost. We reserve the right by giving notice of increase prior to delivery of goods. Prices quoted are including Vat at the current rate ( 17.5% ) but exclude any packaging and carriage  that may apply.

3. PAYMENT – The customer shall pay in full before despatch of the goods unless approved credit has been authorised. Title of goods remains with the company until paid in full

4. DELIVERY – Orders shall be delivered within Three working days from placement of order. ( Special Order Items such as HID lights are built to order so extra allowance should be made for delivery of  these items ) Any delivery date or time quoted is an estimate only and not a term of contract and the company shall not be liable for any losses, costs, damages, or expenses incurred arising directly or indirectly out of failure to meet estimated delivery dates however arising. If at the time of order the goods are not immediately available for delivery the company will advise the customer within one working day and shall deliver the goods when they come available. Deliveries of quantity may be by such instalments, as the company shall determine.

5. SHORTAGES – The correct number of packages should be signed for at the time of delivery. The company must be informed immediately of receiving the respective order of any shortages from deliveries or visible damage to consignment. Within 7 days after delivery the customer shall check the goods and give notice to the company of any damage or defect

6. WARRANTY – All goods are covered only by manufacturer’s warranties and/or guarantees. The company can assume no responsibility for use or application by the user. Warranties only cover parts supplied, and does not cover consequential loss, damage, expenses, or any injury resulting from improperly fitted parts or not installing in accordance to manufacturers instructions. If on delivery there is any damage, defect or shortage in the goods and the customer gives due notice under condition 5 above and returns the damaged or defective goods to the company, the company shall replace the damaged or defective or missing goods or (at the company option) credit the customer with the amount of the price attributed to those goods. Customer’s statutory rights are not affected

7. RETURNS – Goods will only be accepted back onto the company’s premises for credit once prior approval has been obtained and a credit approval number has been issued to the customer. This approval number and the original supply invoice must accompany any returned goods. Unauthorised returns cannot be accepted for refund. Carriage charges are not refundable. Any returned goods will be inspect on receipt and must be in their original packaging, and be accompanied with all instructions and be fit for resale. A handling charge of 15% will be levied for orders correctly executed by the company

8. FORCE MAJEURE – The company shall not be liable in respect of any loss or damage caused by or arising out of any circumstances outside the company’s reasonable control (including without limitation, government regulations or orders, war civil disorder, fire, flood, drought, tempest, theft, industrial dispute delay by suppliers, carriers or other sub-contractors or inability to obtain material, labour or manufacturing services from usual sources).

9. NOTICE TO CUSTOMERS - KC HiLiTES are intended for use solely as auxiliary lighting. KC HiLiTES  are not intended to be used for headlight purposes, nor are they certified for headlight usage. KC HiLiTES makes no representation or warranty, either expressed or implied, as to the legality of its products for street use on any vehicle or in any location. KC HiLiTES are designrd to improve visibility during night time motoring and inclement weather conditions. However, irresponsible use of any auxiliary light can be dangerous and illegal.

10. ACCEPTANCE – The placing of an order with the company constitutes acceptance of these conditions.
